Is USAA Denying Your Med Pay?

We are receiving reports that USAA has embarked on a new program to regularly deny chiropractic med pay claims. The general approaches are as follows:
bulletUpon receipt of med-pay bills, USAA reportedly sends copies to Concentra, its review company
bulletConcentra automatically recommends that no payment be made based upon the need for “more documentation.”
bulletWhen all the records are sent, even repeatedly, Concentra continues to send the same denial EOB form letter as before.
bulletThis ploy continues for months. After threats of legal action, some payment is made but there are typically still unreasonable reductions and unexplained omissions of reimbursement for certain dates of service. 

USAA may have made a significant management decision to see if they can simply stonewall valid chiropractic claims and see where the chips will fall.

California State Automobile Assn. [CSAA] employed this tactic over a decade ago. Without warning thousands of DC’s realized they were not receiving med pay reimbursement. The actions we took were the following:
bulletTook a survey to confirm the extent of the problem;
bulletKept good records of attempts to get paid, via letter and tele logs;
bulletEnlisted the patient to call and write their own insurance company;
bulletSent formal complaints to the Dept of Insurance;
bulletThe San Francisco DA filed a criminal case against CSAA for consumer fraud;
bulletCCA Districts paid for full page ads criticizing CSAA tactics
bulletCCA leaders help recruit candidates to run for the Board of Directors of CSAA for 3 years in a row.

When A Lawyer’s Check Bounces

What are you supposed to do if your check from a lawyers trust account comes back NSF? 

You should report the bounced check to the California State Bar. Anytime a lawyer allows his trust account to go in to the “red” he has automatically misappropriated funds. The “trust” account imposes substantial duties for the attorney. He must act as a fiduciary, that is, must be more concerned with the client’s and doctor’s checks than his own. 

The number one reason why lawyers lose their license is for trust account violations.
