COMMON ERRORS PI REPORTS PART 3.
  1. ATYPICAL? Prove you have unique injuries. Not the same old, same old. Look at the ICD-9 carefully.
  2. AVOID SPRAIN / STRAIN: These are RED flags which usually mean your case is ‘only soft tissue” meaning colossus won’t pay your fees.
  3. AVOID PASSIVE CARE ONLY: Good doctors need to show they offer and train the patient to engage in a home exercise active care regimen. Every arbitrator and judge appreciates an active care doctor.
  4. FAILURE TO EXPLAIN THE RATIONALE FOR FUTURE CARE: Determine the number of flare-up visits since the patient was released to a PRN status, costs of each visit and project costs of a 12 month period.
  5. FAILURE TO DOCUMENT DISABILITY: All patients are, to some extent disabled. Your job is to detail:
    bulletThe amount of time lost from their work. and
    bullet the extent of their limitations of their ADL’s.

NICE WIN IN ALAMEDA CO: Farmers takes a hit. 

Brandon Lane was rear-ended by a Suburban. The estimate to his Toyota was $2845, as a total loss. Lane claimed injuries to his back and neck. Lane claimed medical bills of $5970 and loss of earnings at $6753.

Defendant naturally contented the impact was “minor” thus could not have caused any injury. The defense asked the jury to award only $2248. Lane asked for $5000.00 

Dr. John Batchellar, an orthopedic surgeon testified for defense. Dr. Tara Walsh DC, former president of the Alameda CCA District, testified for her patient, Lane.

The jury believed Dr. Walsh and gave a total of $11,687. The judge will shortly award additional costs to the winning attorney because the jury gave more than Lane asked for.

Farmers will think again before they take on Dr. Walsh or her patients.
