NICE WIN IN ALAMEDA CO: Farmers takes a hit.
Brandon Lane was rear-ended by a Suburban. The estimate to his Toyota was $2845, as a total loss. Lane claimed injuries to his back and
neck. Lane claimed medical bills of $5970 and loss of earnings at
$6753.
Defendant naturally contented the impact was “minor” thus could not have caused any injury. The defense asked the jury to award only $2248.
Lane asked for $5000.00
Dr. John Batchellar, an orthopedic surgeon testified for defense. Dr. Tara Walsh DC, former president of the Alameda CCA District, testified for her patient, Lane.
The jury believed Dr. Walsh and gave a total of $11,687. The judge will shortly award additional costs to the winning attorney because the jury gave more than Lane asked for.
Farmers will think again before they take on Dr. Walsh or her patients.
