COURT DISBARS ATTORNEY – AGAIN

In a rare move the CA Supreme Court disbarred a Pacific Palisades attorney of pocketing “unconscionable fees” from his personal-injury clients and cheating health care providers.

Ruling against Ronald Silverton, who was also disbarred in 1975 for 3 felony convictions, the Court overruled a 60-day suspension recommended by the State Bar Court Review Dept., In Re Silverton, Cal June 23, 2005.

The State Bar Court found Silverton had renegotiated two client’s health care bills with medical providers and kept nearly the entire difference for himself after closing out their settlements.

THE LESSON: Lawyers who cut your fees to fatten their own fees may face discipline from the State Bar.

THE PROBLEM WITH "EXCESS MED PAY"

A common tactic by med pay carriers is to play the waiting game before paying what they owe in MED PAY. Most insurance carriers have what they call “excess” med pay. This means that if the patient has any independent health insurance, the other company needs to pay PI bills first.

It seems illogical that MED PAY would be the second in line to pay auto accident bills. But most carriers use this tactic to wear down possible claims.

THE KEY; when your patient’s MED PAY carrier claim it is excess, either you have to prove that the patient has no applicable health insurance,

bulletYour office prepares a simple letter to be signed by the patient there is no other insurance;

Or if your patient has a Kaiser or a Blue Shield, bill them direct. Ask in your letter for Explanation of Benefits. Generally, that means the health carrier will “deny” payment. That’s what you want. Once you have the “deny” letter, then the “excess” MED PAY become primary and must pay your bills.
