1. History vs. Mechanism of Injury


In our quest to create high value PI reports we offer a break from the past.

Perhaps half the reason DC’s don’t get paid on their PI cases is because the PI report does not justify chiropractic care.

Stop using the outdated Medical Narrative.

Instead consider an OUTLINE approach. Rich in facts with no fluff.

Every report should begin with the beginning. Instead of discussing who caused the accident we should talk about HOW the patient got hurt.

Examples of No no’s
  1. Never “quote a patient” that can be used against the patient in court.
  2. Don’t discuss who’s liable.
  3. Don’t spend time describing the area, weather or people’s opinions.

Examples of what to do:

bulletIf auto accident, tell us what kind of cars.
bulletDetermines relative weights.
bulletHow many impacts.
bulletPosition of patient at time of impact.
bulletWhich cars were towed away?
bulletWhat parts of P’s body were impacted upon collision?
bulletWas P in shock, dizzy, LOC right after impact?
bulletTaken by ambulance?

Nordhoff Wins Again!
Tough Alameda case:
battle of accident re-constructionists.

Amy was recovering from her first accident, seeking care, when she was hit again in 2.5 months. Amy had to sue both defendants.

Defendants blamed each other and both blamed Amy for exaggerating her injuries.

Lawrence Nordhoff, DC and accident reconstruction expert took on defense’s expert Paul Berg PhD.

The 1st was an uncontested rear-end collision. The 2nd involved Amy with an unsafe U turn case. Amy presented only one Dr for both cases. The insurance presented one radiologist and two orthos.

The knock down dragged out trial lasted 14 days. The jury awarded a verdict of $ 39, 276.00. Taylor vs. Copobianco Alameda Sup Ct 200 20 70239

PRACTICE TIPS

  1. If your patient has two accidents within a few months of each other it is the treating doctor’s job to apportion
  2. If the car damages are not significant you might consider an accident recon evaluation.
