"Folks:

I have been continuing my investigation and research on the evolving situation with Silver State post bankruptcy. In this vein, I have reviewed and spoken to two other law firms stepping up to represent former Silver State students, the Brown, Dean law firm in Texas and the Berger law firm in California. At this point I feel you will be better represented by one of the other firms and it is my recommendation that you all sign-up with the Berger Law firm without delay. I have reviewed Mr. Berger’s qualifications and discussed his litigation plan with him. I believe Mr. Berger is eminently qualified to handle this litigation and he has now signed up over 400 other students. There is considerable strength in numbers, and Mr. Berger has already made a considerable investment in the case. I also met two of his attorneys at the bankruptcy 341 hearing and they were very aggressive and on target in their questioning. I will be refunding any remaining trust funds and I plan to have the meeting with you scheduled for April 6th at the usual location in Casa Grande.

     It's true.  As of last night,  in a telephone conference with students from Atlanta, New York and Tulsa, I extended the deadline for people to sign up with us to April 1, 2008.   We are still finding former SSH students that have either just heard about us for the first time or have not heard about us at all.  In addition, several people have told us that they need more time to raise the $800.00.  We do not want to exclude these people.  Although the 341(a) hearing is set for March 10, we anticipate that we will not actually file any lawsuit against the banks until April.  We will begin our negotiations with the banks based on the clients that we already have.

A few points from the 2h15m teleconference with ATL
  • Michael Berger has just extended the hard deadline to retain his firm to April 1st because there are still students finding out that there is a support system set up.
     
  • Berger & Assoc. is charging $800 as a one-time fee. No additional charges will be added to your account -- by contract. Co-signers will be linked together with their student for a one-unit $800 fee.
     
  • AES is giving an automatic 90-day deferment on all loans because they were being inundated by calls from students. We are entitled to four (4) six-month deferments per our contracts. This is merely an initial deferment.
     
  • DO NOT accept a "Forgiveness" of your student loans. If you agree to a forgiveness, you may be issued a 1099-C (C stands for Cancellation of Debt) for the amount of the forgiveness and you may have to pay state and federal income taxes on the amount.
     
  • Students are receiving mail from Attorney McPherson. She is a Jerry Airola attorney. She is offering to file paperwork for students for free. She
    is filing the paperwork against the court case that is linked to a Silver State shell company that has no assets -- not the case against the Jerry Airola big money Silver State court case. DO NOT use her services. She is filing the paperwork in the wrong court.
